A Lawsuit Against Folgers Claims Their Cans of Coffee Don’t Make As Many Cups as Promised

It’s not the first time a client has expressed dissatisfaction with the amount of Folgers in their cup, which is unexpected. We’re willing to guess that when you purchase a can of ground coffee, you don’t keep track of how many cups of coffee you’re able to make from the can. But a Missouri man named Mark Smith believes otherwise: in November, he filed a lawsuit in the United States District Court for the District of Kansas City, alleging that Folgers had “grossly misrepresented” the number of cups of coffee that could be made from canisters of the company’s ground coffee.

Specifically, the lawsuit petition states that the method is a “typical and unlawful bait-and-switch technique that induces naïve customers to pay more money for less coffee than they believe they are obtaining.” The Folgers Business (and its parent firm, the J.M.

Folgers has also stated that its ground coffee can be prepared in a variety of ways; for example, a tablespoon of ground coffee can be used to make a single cup of coffee, while a half cup of ground coffee can be brewed to make 10 servings.

In one of those previous claims, a judge agreed with Folgers, noting that stating “up to” a specific number of serves “does not imply that the number of cups would be attained.” Despite the dismissal of the action, the plaintiff was allowed permission to alter their complaint and re-file it in the future.

Aldif was sued in December by two claimants from New York and California who claimed that the company’s house-brand Beaumont Coffee contained much less coffee than the labels advertised.

A lawsuit has also been filed against the Kroger grocery chain and its parent company, Kraft Heinz, for allegedly overpromising and underdelivering when it comes to cups of ground coffee, according to the lawsuit.

Has anyone bothered to inquire as to the size of these plaintiffs’ coffee mugs? Despite repeated requests for comment, FoodWine has not received a response from the J.M. Smucker Company.
